Synopsis

It is time once again for our ever popular series of breakfast briefings. Dates are set out above.

 Following on from the concerns raised via the Government's "red tape challenge" about the ACAS Code of Practice on Discipline and Grievance, including whether it is sufficiently flexible and clear, these sessions will focus on the application of the Code and addressing the tricky issues that employers often struggle with. For example:

When does the code apply?

Does an employer have to give advance notice of an investigatory meeting?

What do you do about an employee who says they are too stressed to attend a hearing?

Are there any circumstances when you should consider letting an employee be accompanied by someone other than a work colleague or trade union representative?

Can witnesses attend in person to give evidence at disciplinary hearings?

How do trust and confidence issues fit with the code?

The briefing and ensuing discussion will conclude with a mini case law quiz.
