Defending prosecutions
We have defended a number of clients on a range of issues, for example:
-
exercise of emergency powers
-
selling contaminated food
-
misleading pricing of products
-
mislabelling of products
-
product misdescription
-
selling food after use by date
-
breaches of hygiene regulations
-
weights and measures
-
food labelling
-
food safety recalls
-
food poisoning outbreaks.
We are familiar with food authorities and environmental health officers throughout the UK. Our general strategy for clients focuses on trying to persuade the authorities not to prosecute and on minimising publicity risks. Appropriate swift action by specialist lawyers acting in concert with the client's food team can often avert a prosecution in the first place. Nevertheless some cases will inevitably go to prosecution and our food lawyers are all experienced advocates who can see the case right through to conclusion.
The volume of our food law work means that we have excellent contacts with a wide variety of technical specialists who can analyse and challenge prosecution evidence and appear as expert witnesses.
