Food labelling, advertising and sales

We have a large cross-disciplinary team that advises clients on all aspects of consumer law. Our experience covers the whole range of food and drink products, including dairy products, meat products, alcoholic drinks, soft drinks, novel ingredients, health foods, energy foods and fruit juices.

Advice in this area includes:

  • helping to devise attractive but legal names
  • packaging and labelling
  • legal clearance for advertisements 
  • marketing / sales promotions (such as competitions and money-off schemes) 
  • approving copy for adverts 
  • agency contracts, and ASA and Ofcom disputes
  • pricing
  • trade descriptions
  • responding to new EU food legislation.

A common aspect of this work is converting the labels used on products originating outside the EU to comply with British and European requirements. 

Recent topical issues have been health claims, nutrition claims, novel foods and the proposed new EU Food Information Regulation.

Advertising and promotion

Our experience includes:

  • advising on the legality, operation and mechanics of food advertising campaigns including promotions, trade incentives, labelling issues, prize drawers and competitions in order to ensure compliance with the relevant advertising regulations 
  • advertising to children
  • drafting terms and conditions for sales promotions and competitions
  • advising on product labelling, licenses and assignments
  • advising on product registration / (health) claim compliance for a number of food manufacturers
  • carrying out ingredient and art work reviews and advising in relation to the approval of food clients' advertising copy
  • advising on comparative advertising issues
  • dealing with and advising on Advertising Standards Authority complaints and procedure
  • drafting and negotiating all forms of agreements relating to the provision of advertising services including sponsorship agreements, creative/agency services agreements and marketing agreements relating to food product endorsement
  • advising on data protection and direct marketing issues.

We also provide ongoing support and training for our clients on their marketing activities and advertising compliance.
