Getting the most from NEC3

The NEC3 suite of contracts is widely used by public bodies and is used by the Highways Agency and Local Authorities for the procurement of highways works and services.

Based on our experience working for the Highways Agency and Local Authorities, Eversheds has developed bespoke training on the NEC specifically for the public sector. The training is designed to highlight the key issues and project management concepts of the NEC3 suite of contracts and how they can be used where there is collaboration between public bodies and to obtain Best Value. 

Performance related payment and other incentive mechanisms for highways contracts are a key focus of the training. In particular we identify how these can be utilised to align private sector values and aims with those of the public sector.

Issues covered include:

  • general overview - the various NEC forms and the type of work and services they can be used for
  • structure and operation of the contracts
  • the roles and responsibilities of the project team
  • key concepts and allocation of risk
  • project management and the early warning mechanism
  • incentivisation on highways projects - ensuring added value
  • framework and term arrangements
  • collaboration between public bodies developing communication and co-operation between all members of the project team and all stakeholders.

These issues will be covered both by presentations and case studies. At the end of this course, participants will:

  • gain a working knowledge of the NEC3 suite of contracts
  • improve their understanding of the key concepts and legal issues
  • understand the benefits and risks of the NEC3 incentive provisions
  • identify opportunities for added value and savings through contractual mechanisms
  • identify potential longer term contractual arrangements whilst ensuring a competitive procurement process
  • understand how the NEC3 can be used to share expertise and resource with the private sector to the benefit of the public sector.

Public procurement

Voted 'number 1 for public procurement in Chambers and Partners 2008, Eversheds knows that deciding on a procurement strategy is not about sticking a pin in a page or doing what has been done before. Your successful procurement for complex highways projects needs to be sensible and robust, and within the complex matrix of the procurement Regulations, Directives and case law.

The most enduring change to the procurement landscape has come through the introduction of the competitive dialogue procedure. The procedure is becoming commonplace, largely replacing the negotiated procedure for complex contracts. Yet its application can cause anxiety for contracting authorities. 

Based on our extensive experience of working with the public sector - acting on five per cent of all competitive dialogues currently advertised in the UK -  Eversheds' procurement group has developed bespoke training on competitive dialogue specifically for all contracting authorities. 

Our training has been rolled out nationally across our network of offices. The training is designed to highlight the key issues and concepts of competitive dialogue, including big issues such as confidentiality, cost and resourcing the process. We also share our practical 'lessons learned' from our role providing actual hands-on resource in the conduct of many competitive dialogues.

Issues covered include:

  • general overview - the European context, the Treaty and overarching principles
  • how to get started - when can you use competitive dialogue, and what are the key differences?
  • setting evaluation criteria
  • running the dialogue - what you need to achieve
  • closing dialogue
  • dealing with confidentiality issues
  • stakeholder involvement
  • calling for final tenders
  • Alcatel and payment of bid costs
  • lessons learned
  • where to look for guidance.

These issues will be covered both by a formal presentation and real-life case studies.

At the end of this course, participants will:

  • understand the context and the reasoning behind competitive dialogue
  • have the opportunity to discuss issues with leading practitioners who are delivering competitive dialogue procurements across a range of sectors
  • explore in detail how a dialogue can work
  • understand the key drivers /issues for bidders
  • better understand the main procurement risks and how to best manage these
  • work through case studies based on our practical experience.

The training can be provided on site at your offices or at any of our UK offices to suit your needs.
