Agency workers and the law
Organisations relying on agency workers face many challenges. For years, the primary issue of debate surrounding agency workers related to their employment status and distinguishing employees from agency workers. That debate continues amidst abundant case law and is still relevant.
However, the more recent focus of debate has turned to the improvement of employment protection for this group of workers who, in the main, fall outside the protection afforded to employees. Europe agreed the Agency Worker Directive in 2008, providing equal treatment for agency workers in relation to basic employment conditions, and regulations implementing the Directive in the UK will be implemented on 1 October 2011.
