All employers face disciplinary and grievance issues, but conventional internal procedures focus on fault and rarely deliver solutions. With the impending abolition of the statutory Disciplinary and Grievance Procedures, there will be an increased focus on mediation within the workplace. Employers will need to design a process that fits their business need, and ensure that those members of the organisation who are acting as mediators or neutrals are properly trained and supported.

Additionally, all employment tribunal claims are now to be considered for judicial mediation, and the role of the external mediator in employment disputes is growing. Properly managed, a mediation can open the door to constructive and flexible solutions which deliver better business value than courts or tribunals can provide.
