Environmental permits are required for a variety of processes and have complex legislative regimes surrounding how and when they apply, and how they can be varied, transferred or surrendered. Interaction and dialogue with the Regulators that enforce compliance with permits have to be carefully managed.

We have extensive experience of environmental permits and advising on compliance and enforcement. For example, we can:

• advise on compliance issues across the spectrum of environmental legislation
• advise on the process for application, variation, transfer and/or surrender of permits
• advise on the effect of corporate and property transactions on the ownership and transfer of permits
• negotiate with regulators where enforcement is threatened with a view to avoiding formal enforcement; and also with regard to the requirement for and scope of permits
• advise on challenging a decision to refuse a permit, grant subject to conditions, or grant to a competitor, including Judicial Review
• defend enforcement proceedings and represent you in inquiries
• advise on appeals against permit conditions, variations or revocations and enforcement and suspension notices.
