We have a dedicated IP education team who are experts in advising universities and their subsidiary companies on the best way to protect, commercialise and defend IP in a number of areas.

Our specialist teams understand staff and student issues and work with academic institutions to strike the often difficult balance between the academics' desire to publish information and the need for confidentiality and the appropriate legal protection.

We understand that universities often need to leverage more income from their IP, and widen access to their courses, and we are advising more and more institutions on the use of materials for distance learning. We advise and provide workshops on the use of copyright materials of third parties in course materials, including in the context of digital delivery.

Research and development contracts provide vital income for universities and using our knowledge of the terms of the Research Councils and many charitable supporters of research we prepare and advise on all such contracts, including related confidentiality arrangements or Material Transfer Agreements.

Main services in this area include:

  • drafting and advising on the content of intellectual property and research ethics policies
  • advising on dealing with the student contract to capture intellectual property
  • drafting standard form consultancy, confidentiality and research agreements
  • preparing Consortium Agreements in relation to Framework 6 and other research contracts
  • advising on and preparation of Knowledge Transfer Partnership (formerly TCS) contracts
  • reviewing clinical trials agreements and indemnities
  • technology licensing including advice on the relevant block exemption
  • drafting pipeline agreements
  • advising on the rights to copy/quote from third party materials both in teaching, examination and research documents
  • advising on the capture of intellectual property rights in learning materials and the legal implications of distance learning, including rights clearance agreements.
