Brand and other intellectual property protection

Our intellectual property team has a wide range of experience in relation to food sector clients which include:

  • advising on commercial distribution agreements
  • all aspects of branding (including trade mark and character licences)
  • sponsorship agreements
  • personality endorsements of food products
  • know-how licences
  • technology and patent licences
  • design right assignments
  • advice in relation to promotions.

Some examples of the types of work we do in the food sector are:

  • advising on a problem which arose when it emerged that our client's brands and proposed brands impinged on third party brands
  • successfully dealing with injunction proceedings brought against a client to restrain the sale of its food product, which had a similar name to that of a very well known brand in the food and drink sector.
