Statutory nuisance
The challenges faced by our clients
Residential development has encroached upon many traditionally industrial areas and the expectations and tolerances of those residents has changed dramatically. Previously tolerated working practices are coming under increasing scrutiny because of their environmental impacts and local authorities are ever conscious of their duties towards their tax payers.
Abatement action for statutory nuisance is increasingly being used to deal with operational impacts and can cause considerable difficulties because of the subjective perceptions that give rise to complaint.
How we can help
Our team has extensive experience of advising on statutory nuisance. For example, we have:
-
advised on liaison with local authorities with a view to avoiding the service of abatement notices
-
engaged appropriate technical experts to advise on mitigation, best practicable means and technical solutions
-
advised on negotiations with local authorities to agree acceptable compliance
-
advised on appeals against abatement notices in relation to, for example, noise from a PA system, odour from a rubber foam manufacturing factory and noise and vibrations coming from a music rehearsal room.
