Road transport

Today's challenges

According to the latest statistics from the HSE, there are around 220 work related fatalities each year. In contrast, there are between 800 and 1,000 road traffic fatalities each year which involve workplace driving.

However, until recently, this area of health and safety law has not necessarily attracted the attention which these shocking statistics suggest it should. It is also worth noting that, although to date there have only been seven successful convictions for Corporate Manslaughter, three of these have related to transport companies or transport activities.

In addition to the general duties of employers to consider workplace driving in the same way as they consider any other aspect of their employees’ activities, there are also an enormous number of technical regulations which apply to road transport, from individual offences such as speeding or driving whilst under the influence of alcohol, through to vehicle offences such as overloading or tachograph retention.

How we can help

Workplace driving and road transport issues affect every organisation to a greater or lesser extent. We can help you to ensure that you meet your obligations as far as this often complex area of law is concerned.

We can provide advice on how you currently deal with workplace driving and how any systems might be improved.

How we have helped others

  • Attending Public Inquiries in front of the Traffic Commissioner in relation to alleged breaches of Operator Licence Conditions.
  • Advising national and international companies on obligations to maintain robust systems for operators of their transport fleets.
  • Representing individuals facing loss of livelihood if their driving licence is removed.
