Introduction

The challenges

Inquiries entail intensive investigation of an issue or event. They often involve numerous documents and large numbers of witnesses. There may be press interest. The matter being investigated may be extremely sensitive and / or it happened a long time ago. In addition, some witnesses may be suspicious and distrustful of the process and may, therefore, be reluctant to co-operate. The Investigation may involve issues of sensitivity in the organisation and may have the potential to cause huge damage to reputation. Reaction will need to be swift, and investigations will need to root out the truth relating to the areas of concern.

The Inquiries and Investigations capability of Eversheds is as wide as the disciplines covered by the firm. In each case, the Inquiry or Investigations will involve specialists in the discipline covered.

Our approach is usually to discover the truth as to what has happened. Our inquisitorial approach engages the witness, ensuring "buy in" to the investigative process from all participants.

Our aim is to produce high quality evidence, obtained fairly, so the Client can decide what judgments need to be made, or what best to do. If required by a Client we will also make findings and recommendations for the future, based on the evidence we have discovered.

We appreciate that Inquiries and Investigations can be stressful for those involved. Our aim is to undertake our work in a way that minimises the stress for participants and witnesses, but maximises confidence in the process.
