The Pensions Regulator has very significant powers (known as its 'anti-avoidance powers') to make a company (and even its directors) liable for funding the defined benefit pension schemes of its associated companies. It could use these powers to require the recipient to pay (or guarantee the payment of) very material sums to the relevant pension scheme.
Given the risks of having the anti-avoidance powers exercised against someone, many people are seeking clearance for almost every act. This however can be very expensive and time consuming.
